Abstrakt

The problem of preferential rules embodies several essential issues of searching for the optimal proportion between the security provided by the police and the liberties of citizens. Preferential rules are related to various particular conflicts brought about by carrying out the security functions of the police. The rules consist of values, that ought to be profoundly judged in every particular situation, as well as of proofable standards of various emergencies, i. e. the threats to the values secured by the police. Further reasonings are then to be carried out in two ways: by artuculation of the rules in their pragmatic functions and by making more clear the meaning of the rules for the new philosophy of the police and for the ground free order in a law state.
